Welcome to Klozzete. These Terms of Service ("Terms") govern your use of the Klozzete mobile and web application (the "Service"), operated by Ayman Elnaham ("we," "us," or "our"), based in New York, USA. By creating an account or using Klozzete, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who Can Use Klozzete
You must be at least 13 years old to use Klozzete. If you are under 18, you confirm that a parent or legal guardian has reviewed these Terms and agrees to them on your behalf. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
2. Your Account
You agree to provide accurate information when creating an account and to keep it up to date. You may not share your account with others, create accounts using false information, or create accounts on behalf of someone else without permission. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Your Content
Klozzete lets you upload photos of your clothing, accessories, and other personal items ("Your Content"). You retain ownership of Your Content. By uploading it, you grant us a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely for the purpose of providing the Service to you. This includes:
- Storing your photos and item details in our database
- Processing your photos with AI to identify clothing categories, colors, and styles
- Generating outfit recommendations from your uploaded items
- Learning your style preferences over time to improve recommendations
We do not sell Your Content to third parties. We do not use Your Content to train general AI models outside of personalizing your Klozzete experience.
You are responsible for the content you upload. You agree not to upload content that:
- Infringes on someone else's copyright, trademark, or other rights
- Contains nudity, sexual content, hate speech, or harassment
- Violates any laws or regulations
- Contains malware or attempts to disrupt the Service
We may remove content that violates these Terms without notice.
4. AI-Generated Recommendations
Klozzete uses artificial intelligence to suggest outfits, identify clothing categories, and learn your style preferences. AI recommendations are provided "as is" for your convenience and inspiration. We do not guarantee that recommendations will match your taste, fit your body, be appropriate for every occasion, or be free of errors.
You understand that AI may make mistakes. Klozzete is not responsible for fashion choices, social outcomes, or any consequences arising from outfit recommendations.
5. Subscriptions and Payments
Klozzete offers a free tier and paid subscription plans (such as Klozzete Plus). Pricing and features are described in the Service. By subscribing, you authorize us (or our third-party payment processor) to charge you on a recurring basis until you cancel.
Subscriptions auto-renew unless you cancel before the renewal date. You can cancel anytime through the settings of the platform you subscribed through (such as your app store account or our payment processor). Refunds are handled according to the policies of the platform you subscribed through.
We reserve the right to change pricing or features with reasonable notice. Continued use of paid features after a price change constitutes acceptance of the new price.
Paid plans may include a free trial period. If a free trial is offered, you will not be charged until the trial ends, and you may cancel at any time before the trial ends to avoid being charged.
6. Acceptable Use
You agree to use Klozzete lawfully and respectfully. You will not:
- Reverse-engineer, copy, or attempt to clone the Service
- Use bots, scrapers, or automated systems to access the Service
- Attempt to gain unauthorized access to other accounts or our systems
- Use Klozzete to harass, threaten, or harm others
- Misrepresent the Service or claim affiliation with us when you have none
7. Intellectual Property
The Klozzete name, logo, app interface, software, design, and all related materials are owned by Ayman Elnaham and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without written permission.
8. Termination
You may stop using Klozzete and delete your account at any time through the Profile screen. We may suspend or terminate your account if you violate these Terms or if we are required to do so by law. Upon termination, your data will be deleted in accordance with our Privacy Policy.
9. Disclaimers
Klozzete is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee that AI recommendations will be accurate, that uploads will always succeed, or that data will never be lost. Use the Service at your own risk.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, Ayman Elnaham and Klozzete will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service will not exceed the amount you paid us in the 12 months before the claim arose, or $50, whichever is greater.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and notify you through the app or by email if the changes are significant. Continued use of Klozzete after changes take effect constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts located in New York County, New York.
